Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the iViCAM website ("Website") and the iViCAM software, operated by Lumirah Pty Ltd ("Lumirah," "we," "our," or "us"). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

These Terms are an agreement between you and Lumirah Pty Ltd. They apply to this website, to iViCAM software and to iViCAM Pro licences. Payments through Paddle.com cover iViCAM software licences only. They do not cover physical products or hardware bundles.

Use of the Website

You may use the Website for lawful purposes only. You agree not to:

• Use the Website in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Website, its servers, or any connected systems.
• Interfere with or disrupt the Website or its infrastructure.
• Scrape, crawl, or use automated tools to extract content from the Website without our written permission.
• Transmit any malicious code, viruses, or harmful data through the Website.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We reserve the right to restrict or terminate your access to the Website at any time, without notice, for any reason.

Intellectual Property

All content on the Website, including text, graphics, photographs, logos, trademarks, product designs, software, and other materials, is the property of Lumirah Pty Ltd or its licensors and is protected by Australian and international intellectual property laws.

The iViCAM name, logo, and software are proprietary to Lumirah. You may not reproduce, distribute, modify, create derivative works from, or publicly display any content from the Website without our prior written consent.

Limited, non-commercial use of Website content for personal reference is permitted, provided you retain all copyright and proprietary notices.

iViCAM Software and Pro Licences

Licence. iViCAM Basic is free to use. An iViCAM Pro licence lets you use the Pro features on up to 2 Windows PCs at a time. You can move a licence to a new PC from the app. If you own an iVi camera, Pro unlocks while it is connected. We give you a licence to use the software. We do not sell you the software.

Free trial. You can try iViCAM Pro free for 14 days from the app. You do not need to give payment details. Each person and each PC can have one free trial. When the trial ends, Pro turns off unless you buy a licence.

Payment.Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service for payments and handles returns. Paddle's Buyer Terms also apply to your purchase.

Subscriptions. Monthly and yearly plans start when you buy them. They renew each month or year until you cancel. You can cancel at any time. Pro stays on until the end of the period you paid for. A lifetime licence is a single payment and does not renew.

Refunds. You can ask for a refund within 30 days of any payment. See our Refund Policy.

Acceptable use. You must not: share or sell your licence key; use the software for unlawful purposes, fraud or spam; copy, modify, reverse engineer or bypass the licence check, except where the law allows it; infringe the rights of others; or interfere with the security of the software or our services.

Ownership. Lumirah Pty Ltd owns iViCAM and all rights in it. These Terms do not give you any rights in our name, logos or technology.

Service. iViCAM checks your licence when you are online. We do not promise that the software or the licence service will be available at all times or free of errors.

Suspension and termination. We can suspend or end a licence if you seriously break these Terms, do not pay, share your licence key, or put the security of our service at risk. We can also do this if we detect fraud, or if you break these Terms again after we tell you about it.

Third-Party Links and Services

The Website may contain links to third-party websites or services, such as the Microsoft Store and Paddle.com. These third-party services are not under our control, and we are not responsible for their content, privacy practices, or terms of use. We encourage you to review the terms and privacy policies of any third-party service you access through our Website.

Disclaimer of Warranties

The Website and its content are provided "as is" and "as available," without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Website will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the Website.

Limitation of Liability

To the maximum extent permitted by applicable law, Lumirah Pty Ltd, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Website.

This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses. Our total liability for any claim arising from or relating to these Terms or the Website shall not exceed AUD $100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability under the Australian Consumer Law.

Indemnification

You agree to indemnify and hold harmless Lumirah Pty Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Website or violation of these Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of Western Australia, Australia. Any disputes arising from these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts of Western Australia.

Modifications to Terms

We may revise these Terms at any time by updating this page. The "Last updated" date at the top indicates the most recent revision. Continued use of the Website after changes are posted constitutes your acceptance of the revised Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary. The remaining provisions will continue in full force and effect.
